Terms and Conditions

Overview

These Terms and Conditions ("Terms") govern your use of the TypeMenu platform and services provided by TypeMenu Ltd, a UK-registered company ("we", "us", or "our"). By subscribing to or accessing our software, you agree to comply with these Terms.

If you are a customer placing an order through a business storefront powered by TypeMenu, please refer to the relevant business local terms and platform notice displayed during checkout.

1. Software Access and Licensing

TypeMenu Ltd provides licensed access to its platform on a subscription basis. Upon subscribing, you are granted a non-exclusive, non-transferable right to use the software for your business in accordance with these Terms.

You must not:

  • Resell, sublicense, or white-label the platform without written permission
  • Use the platform for purposes outside the food and beverage sector
  • Upload or list any banned products (see Section 5)

2. Payment and Subscription

All payments are securely processed via Stripe. By subscribing, you authorise TypeMenu Ltd to charge your selected payment method for the applicable subscription fees.

  • Upgrades take effect immediately, and your account will be charged a prorated amount for the remaining period in the billing cycle.
  • Downgrades take effect at the start of your next billing cycle.
  • Non-payment or failed charges may result in restricted access or account suspension after repeated failed collection attempts.

You can manage your subscription, billing information, and plan settings directly via your admin panel.

3. Termination and Account Deactivation

You may cancel your subscription at any time. Your account will remain active until the end of the paid period.

We reserve the right to suspend or terminate access to the platform without notice in cases of:

  • Breach of these Terms
  • Unlawful use
  • Failure to pay after multiple attempts

4. Platform Availability and Support

We aim to provide a reliable and secure service with high uptime. However, we do not guarantee uninterrupted access and are not liable for delays or outages caused by factors beyond our control.

Support is available via the communication channels listed on our website. Enterprise or priority support may be available for certain plans.

5. Prohibited Products and Content

You agree not to use the platform to promote or sell any goods that:

  • Are unrelated to food and beverage services
  • Violate our Payment Partner’s Acceptable Use Policy (e.g., CBD, adult content, weapons)
  • Are illegal under UK law or local jurisdiction
  • Could harm our reputation or the stability of our payment infrastructure

We reserve the right to suspend any account found in violation of this section.

6. Data Handling and Privacy

As a platform provider, TypeMenu Ltd acts as:

  • A data controller for business accounts and subscription services
  • A data processor for customer information submitted via storefronts

We comply with the UK GDPR and are registered with the Information Commissioner's Office (ICO). Please refer to our Privacy Policy for full details.

7. End-User Terms

Where TypeMenu Ltd software is used to provide a business storefront, the following terms also apply to customers placing orders:

  • TypeMenu Ltd is not the seller and bears no responsibility for product quality, preparation, delivery, or refunds.
  • All transactions are between the customer and the business operating the storefront.
  • TypeMenu Ltd processes personal data strictly to enable orders and maintain service integrity, in accordance with our role as a data processor.

8. Changes to Terms and Policies

TypeMenu Ltd reserves the right to update or modify these Terms and related policies (including the Privacy Policy) at any time, without prior notice. Continued use of the platform after changes have been published constitutes acceptance of the revised terms.

We encourage you to review our legal pages periodically to stay informed.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
